Be Careful What You Wish For
Rush Limbaugh was on an absolute TEAR yesterday morning - ranting about the "activist judge" in California that over-rode the will of the electorate in striking down Prop 8....
A federal judge in California has struck down that state's ban on same-sex marriage, saying Proposition 8, passed by voters two years ago, is unconstitutional.
...and the "activist judge" in Arizona over-riding the will of the electorate in weakening SB1070....
Today, US District Judge Susan Bolton issued a preliminary injunction blocking the enforcement of three major provisions of Arizona SB 1070, the state's immigration law scheduled to take effect shortly.
...and pretty much saying that the results at the ballot box are sacrosanct.
Conversely, there are many on the left who today are celebrating those two judgments and yet they were spitting nails in 2004 when the Electoral College gave the Presidency to George W. Bush over John Kerry (who won the popular vote). Those same folks are now working hard to eliminate the electoral college in favor of the popular vote.
Both right and left have taken their turns on the "will of the electorate" soapbox - when the will of the electorate was in line with their particular point of view......
My advice to BOTH sides - be careful what you wish for. Because at some point in time, the electorate will NOT agree with you and you WILL be on the losing side of a popular vote. BANK ON IT. If you want the popular vote to be the be all and end all - you had better be able to live with it when you do eventually lose an election.
